BTravelrs Inc. Copyright Policy

Our Copyright Policy specifies how copyright holders and their authorized agents can request for content to be removed, as well as the consequences to users who upload such content to BTravelrs. BTravelrs respects the intellectual property of others and asks that users of our Site and/or the App do the same. In connection with our Site and/or the App, we have adopted and implemented a policy respecting copyright law that provides for the removal of any infringing materials and for the termination, in appropriate circumstances, of users who are repeat infringers of intellectual property rights, including copyrights.

Digital Millennium Copyright Act (DMCA) Notice

BTravelrs is committed to upholding the laws set forth in the Digital Millennium Copyright Act (DMCA). We recognize the importance of protecting the rights of copyright owners and will promptly address any claims of copyright infringement in accordance with the DMCA's provisions. Our policies and procedures are designed to ensure compliance with the DMCA, including the prompt removal of infringing content upon receipt of valid notices. We strive to maintain a platform that respects intellectual property rights and fosters a safe and lawful environment for all users.

DMCA Takedown Notice and Process

If you believe that one of our users is, through the use of BTravelrs, unlawfully infringing the copyright(s) in a work, and wish to have the allegedly infringing material removed, the following information in the form of a written notification (pursuant to 17 U.S.C. § 512(c)) must be provided to our designated Copyright Agent following the process below:

  • File a notice by email to legal@btravelrs.com including the following:

    • Your physical or electronic signature.

    • Identification of the copyrighted work(s) that you claim to have been infringed.

    • Identification of the material on our services that you claim is infringing and that you request us to remove.

    • Sufficient information to permit us to locate such material.

    • Your address, telephone number, and e-mail address.

    • A statement that you have a good faith belief that use of the objectionable material is not authorized by the copyright owner, its agent, or under the law.

    • A statement that the information in the notification is accurate, and under penalty of perjury, that you are either the owner of the copyright that has allegedly been infringed or that you are authorized to act on behalf of the copyright owner.

Please note that, pursuant to 17 U.S.C. § 512(f), any misrepresentation of material fact (falsities) in a written notification automatically subjects the complaining party to liability for any damages, costs and attorney’s fees incurred by us in connection with the written notification and allegation of copyright infringement.

DMCA Counter-Notifications

If you are a BTravelrs user and would like to dispute and reverse the removal of your contributions due to an earlier DMCA takedown notice, you must:

  • File a notice by email to legal@btravelrs.com, including the following:

    • A physical or electronic signature of the user.

    • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.

    • A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

    • The user's name, address, and telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the user's address is outside of the United States, for any judicial district in which the service provider may be found, and that the user will accept service of process from the person who provided notification under DMCA subsection (c)(1)(C) or an agent of such person.

Pursuant to the DMCA, we will forward any complete counter-notification to the person who filed the original DMCA notice. The copyright owner and its agents may then choose to file a lawsuit against you for copyright infringement. If we do not receive notice that such a lawsuit has been filed within 10 business days after we provide notice of your counter-notification to the copyright owner or their agent, we may restore the challenged materials. Until that time, your materials will remain removed.

Bans for Repeat Infringers

If we find that content uploaded by the same user has repeatedly caused us to receive DMCA notices, we will delete the user's account and restrict their access to BTravelrs using technological measures.
